Terms of Service

By downloading, accessing, or using Rise ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

1. Acceptance of Terms

By creating an account and using Rise, you confirm that:

• You are at least 13 years of age
• You have read and understood these Terms
• You agree to comply with all applicable laws
• If under 18, you have parental/guardian consent

2. Use of the App

Rise is designed for personal mindfulness and well-being. You agree to:

• Use the App only for personal, non-commercial purposes
• Provide accurate information when creating your account
• Maintain the security of your account credentials
• Not share your account with others
• Not use the App for any illegal or harmful purposes
• Not attempt to hack, reverse engineer, or disrupt the App

3. User Accounts

• Account Creation: You must provide a display name
• Friend Code: You receive a unique code to connect with friends
• Responsibility: You are responsible for all activity on your account
• Security: Notify us immediately of any unauthorized access
• Termination: We may suspend or terminate accounts that violate these Terms

4. Meditation Sessions

Random Matching:

• You may be paired with random users worldwide
• Sessions are anonymous but show names and approximate locations
• You can skip or end sessions at any time

Friend Sessions:

• You can add friends using unique friend codes
• Friends can invite you to meditation sessions
• You control who you add as a friend

Conduct:

• Be respectful to all meditation partners
• Do not harass, abuse, or spam other users
• Report inappropriate behavior immediately
• We reserve the right to ban users who violate conduct rules

5. Subscriptions & Payments

Free Trial:

• 3-day free trial for new users
• Access to all premium features during trial
• Cancel anytime during trial to avoid charges

Subscription:

• $3.99 per month after trial ends
• Automatically renews monthly unless cancelled
• Charged through Apple App Store
• Cancel at least 24 hours before renewal to avoid next charge

Cancellation:

• Cancel anytime in iPhone Settings → Subscriptions
• Access continues until end of current billing period
• No refunds for partial months or unused time

Price Changes:

• We may change subscription prices with 30 days notice
• Existing subscribers keep current price until renewal

6. Content & Intellectual Property

• Your Content: You own your meditation data and statistics
• Our Content: All app design, code, sounds, and materials are our property
• License: We grant you a non-exclusive license to use the App
• Restrictions: Do not copy, modify, or distribute our content

7. Data & Privacy

Your use of Rise is also governed by our Privacy Policy. Key points:

• We collect your name, friend code, and approximate location
• Data is stored securely in Firebase (Google Cloud)
• We never sell your data to third parties
• You can delete your account and data anytime

8. Health & Medical Disclaimer

• Rise is for wellness and relaxation purposes only
• Not intended to diagnose, treat, or cure any medical condition
• Consult a healthcare professional for medical advice
• If experiencing mental health crisis, contact emergency services
• We are not responsible for any health outcomes

9. Disclaimers & Limitations

No Warranties:

• App provided "AS IS" without warranties of any kind
• No guarantee of uninterrupted or error-free service
• No guarantee of specific meditation results

Limitation of Liability:

• We are not liable for indirect, incidental, or consequential damages
• Maximum liability limited to amount paid in last 12 months
• Not responsible for user-to-user interactions
• Not responsible for third-party services (Firebase, RevenueCat)

10. User Responsibilities

You are responsible for:

• Your device, internet connection, and data charges
• Backing up any important data
• Compliance with local laws regarding meditation apps
• Your interactions with other users
• Maintaining confidentiality of your account

11. Termination

By You:

• Delete your account anytime through app settings
• Cancel subscription through iPhone Settings
• All data permanently deleted within 30 days

By Us:

• We may suspend or terminate accounts for Terms violations
• We may discontinue the App with 30 days notice
• Termination does not entitle you to refunds

12. Changes to Terms

We may update these Terms at any time. Changes become effective immediately upon posting. We will notify users of significant changes through:

• In-app notification
• Email to registered users
• Updated "Last Updated" date on this page

Continued use after changes constitutes acceptance of updated Terms.

13. Governing Law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law principles.

14. Dispute Resolution

• Disputes will be resolved through binding arbitration
• Arbitration conducted in English in California
• No class action lawsuits permitted
• Small claims court option available

15. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect.

16. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Rise regarding use of the App.
